Not legal advice. This post summarizes public information as of October 2026 so customers know what to expect at the counter. Laws change; check the official source or ask a lawyer about your own situation.

The short version

  • You must be 21 to buy, and you cannot even enter a licensed vape shop in Alabama if you are under 21.
  • Stores can sell only products listed on the Alabama ENDS Directory.
  • From October 1, 2026, nicotine e-liquid carries a state tax of 10 cents per milliliter.
  • From October 1, 2026, vaping falls under Alabama's indoor smoking law.

How old do you have to be to vape in Alabama?

21. Federal law raised the minimum age for all tobacco and nicotine products, vapes included, to 21 in December 2019, and Alabama law follows it. Retailers must check photo ID for anyone under 30. At our stores we check ID on every purchase, whatever your age.

You cannot buy a vape at 18 in Alabama, or in any other U.S. state.

Which vapes are legal in Alabama? (Act 2025-403)

This is the big one. Known as HB8 while it went through the legislature, it created a license for "specialty retailers": stores like ours that focus on vapor products. A specialty retailer pays a yearly license fee for each location and, in return, can sell a wider range of products than a gas station or convenience store. The trade-offs:

  • Nobody under 21 inside. Specialty retailers must keep under-21s out of the store and use third-party age verification at the door. That is why you may be asked for ID before you reach the counter.
  • Directory only. Every product must be on the Alabama ABC Board's ENDS Directory. Since October 1, 2025, new products can only be listed if they are FDA-authorized or made, packaged and labeled in the U.S.
  • No health claims, and no advertising aimed at kids. No cartoon or candy-style imagery, and limits on exterior signs.

The law was challenged in court. In July 2026 the Alabama Supreme Court upheld a lower court's refusal to block it, so it remains in force.

Can you still buy vapes at gas stations in Alabama?

Some, but the range is narrower. Retailers that are not licensed specialty retailers face tighter limits on which products they can carry. If you are looking for a particular device, coil or e-liquid line, a licensed vape shop is the most likely place to find it.

Act 2025-377: the e-liquid tax (October 1, 2026)

Alabama now taxes nicotine-containing vapor liquid at 10 cents per milliliter. Wholesalers collect it, so it shows up in the shelf price rather than as a separate line on your receipt. On a 30ml bottle that is $3.00 of tax; on a 10ml bottle, $1.00. Nicotine-free liquid is excluded. More on the tax.

Act 2026-505: vaping and the Clean Indoor Air Act (October 1, 2026)

Alabama added electronic nicotine devices to its indoor smoking law, so vaping is now banned in most enclosed public places and workplaces, the same as cigarettes. What the indoor ban covers.

Smokable hemp

Separately, a 2025 hemp law banned smokable hemp products in Alabama from July 1, 2025, including hemp vapes and cartridges. We do not sell them.
