Are vapes illegal in Mississippi?
No. Adults 21 and over can still buy vapes in Mississippi. What changed is which products a store can sell. House Bill 916, signed on March 20, 2025, created a state directory of vapor products, and retailers may only sell products on it.
Which products make the list
A product can be listed if its manufacturer shows one of three things:
- The FDA has granted it a marketing authorization, or
- The manufacturer filed a premarket tobacco product application (PMTA) with the FDA that is still pending, or
- The FDA denied it, but a court has stayed or overturned that denial.
Products that were never submitted to the FDA, or were denied with no court relief, cannot be listed. Many single-use disposables imported in recent years fall into that group.
The timeline
- March 20, 2025: HB 916 signed.
- October 1, 2025: the first directory published.
- About December 1, 2025: the 60-day sell-through period ended and enforcement began.
What happens to stores that sell unlisted products
Unlisted products are treated as contraband and can be seized. Reported penalties run from $500 to $1,500 per product per day, and a store can lose its tobacco license. That is why responsible shops pulled unlisted stock quickly.
What it means at our D'Iberville store
Our D'Iberville store on Sangani Blvd only stocks products on Mississippi's directory. Alabama's directory has different rules, so the shelves in D'Iberville are not identical to our Mobile and Daphne stores. If you are looking for something specific, call (228) 207-2567 before you drive.
Can I order vapes online in Mississippi?
We do not sell or ship vapes online, from any of our stores. Federal law (the PACT Act) puts strict rules on shipping vapor products, and the directory requirement applies to products sold in Mississippi either way.
