What changed
Act 2026-505 (SB 9) added electronic nicotine delivery systems to the definition of smoking in the Alabama Clean Indoor Air Act. From October 1, 2026, anywhere you could not smoke a cigarette, you cannot vape either.
Where can't you vape in Alabama?
Enclosed public places and workplaces covered by the act, which include:
- Restaurants and most retail stores
- Offices and other workplaces
- Public buildings, schools, hospitals and child care facilities
- Public transportation and waiting areas
- Elevators, restrooms and lobbies open to the public
What is still exempt
The new law left the act's existing exemptions in place. Those include bars and lounges, private residences (unless used as a child care business), and retail tobacco stores and tobacco businesses. How the tobacco-store exemption applies to vape shops has not yet been clarified by the state.
What happens if you get caught vaping indoors?
A person who vapes where it is banned can be fined $25 per violation. The person in charge of a business that does not comply can face fines of $50, then $100, then $200 for repeat violations.
Local rules
Cities and counties can set stricter rules than the state. If you are in Mobile, Daphne, Fairhope or elsewhere, a local smoke-free ordinance may also apply.
What about our stores?
We are confirming how the law applies to our Alabama stores and lounges. Until then, please follow staff instructions and the signs posted in each store. See our store rules.
